Raleigh-Egypt Senior High School math teacher Adam Guerrero, who tends your garden with three neighbors and students, (Jarvis, Jovantae, and Shaquielle) was reported through the city for developing a public nuisance - particularly with breaking city ordinance 48-38, which states that "It will be illegal for just about any who owns personal property to fail or won't adhere to the orders from the manager of housing and the code enforcement department to get rid of in the premises abandoned automobiles, home appliances, vehicle parts and/or other piece or bits of personal property if such personal rentals are harmful towards the public health, safety or welfare or produces an unsightly condition upon such property looking after lessen the value thereof or perhaps is an annoyance or invites plundering or encourages urban blight and degeneration locally or produces a fireplace hazard or violates the zoning rules from the city."
Yeah. I'm able to totally observe how an outdoor and a few beehives (that are completely legal in Memphis, incidentally) violates this code.
Guerrero can also be in breach of city code 48-87, which states "All exterior property areas will be maintained inside a neat and sanitary condition free of any accumulation of rubbish or garbage."
Well, everyone knows how unclean gardens are. Everything grime, and existence, and.... well I am clutching my pearls just considering it. (Incidentally, if you are thinking about seeing photos of Adam's not really remotely unclean, blight-inducing garden, the Memphis Flyer published a number of them online.)
Absurd Laws and the authority to Garden
We have experienced this before. Recall the story the 2009 summer time in regards to a Michigan mother who had been facing 93 days in jail for planting a vegetable garden Or even the ongoing story of the Bc guy who's facing 6 several weeks in jail for growing as well as the 100s, otherwise 1000's, of other home gardeners who get bothered for doing simply attempting to live a far more sustainable existence to possess some reference to the meals they eat within an era when shrink-wrapped, flavorless food reigns supreme. This needs to stop.
The issue with several laws, such as the Michigan situation in addition to this new Memphis situation, is the fact that an outdoor turns into a "public nuisance" when your neighbors calls to complain about this. One neighbor, a couple of neighbors, shouldn't possess the energy to dictate what qualifies being an "acceptable, neat, clean" yard. Vegetable gardens commonly are not showpieces. They're working, changing environments filled with existence. They are filled with beauty - simply not the type of beauty that HGTV and many gardening magazines sell us.
The Best Way To Help
Adam Guerrero continues to be purchased to dismantle his garden before his court date on September 23rd. He's (naturally) been stalling taking apart it, because of all the work he and the students have put in it. TreeHugger and it is visitors designed a massive difference within the situation from the Michigan garden enthusiast. As we published here, other media shops acquired about the story. Our awesome community of visitors authored emails, made telephone calls, and published like mad on Twitter and facebook. Ultimately, the town of Oak Park dropped the costs, along with a garden was saved. This garden enthusiast and the students can use your help, too!
1. There's a web-based petition you are able to sign at change.org meant for your garden, which is delivered to the judge hearing Guerrero's situation.
2. Email Judge Ray Potter at ray.potter@shelbycountytn.gov meant for Adam Guerrero's garden.
3. There's a Facebook page known as "Save Adam Guerrero's Garden," where one can show your support and receive updates about his situation.
4 .Tweet and retweet! The hashtag #WarOnGardens has began attaining steam among garden writers and garden authors, and it is a great way to stay in touch with other people who're frustrated with this particular anti-gardening nonsense.
We have tried it before, and that we can try it again. Let us save an outdoor, TreeHuggers!
