Today the Munich I Regional Court passed down a choice giving Apple an injunction against all Motorola items that violate a patent on "portable digital camera[s] for photo management." That excessively broad-sounding claim seems to use particularly towards the bouncing over scroll animation based in the company's photo gallery application, so a little tweak towards the existing software could rapidly and silently put this problem to relaxation. Still, based on
FOSS Patents' Florian Mueller, there's a little (and that we do mean
small) chance that Apple could decide to enforce the prohibit, that could require Motorola to eliminate all existing items that violate the claim. Including products already on shelves, which would need to be remembered. Much more likely though, despite Apple's victory concerning the zoomed-
out because within the Android gallery application, Motorola continues to have the ability to sell the Xoom and 2 infringing phones. On the somewhat related note, could it be safe yet to formally dub Germany the successor to Texas' Eastern District -- patent trolling capital around the globe
Update: We erroneously mentioned it was the zoomed-out view which was discovered to be in breach from the patent, much more fact it had been the zoomed-in a single. Motorola effectively defended itself against claims the zoomed-out interface also infringed on Apple's patents. Motorola arrived at to us using the following statement:
"Present day ruling in Munich, Germany around the patent lawsuit introduced by Apple concerns an application feature connected with carrying out certain functions when viewing photos inside a 'zoomed in' mode on mobile products. We observe that a legal court ruled that carrying out the functions inside a 'zoomed out' mode doesn't infringe about this patent. We expect no impact to provide or future sales once we have previously implemented a different way to see photos on our items that doesn't hinder the consumer experience."
