Inside a completely expected move, Samsung today filed to appeal the preliminary Universe Nexus prohibit granted to Apple a week ago, moving to remain the injunction. Among other claims, Samsung is quarrelling the prohibit is "sporadic using the Federal Circuit's directive that share of the market deficits should be substantial," and, as Foss Patents puts it, "due to the 'infringing feature,' not only the existence of the infringing product available on the market.Inch This, obviously, mirrors Samsung's appeal for that Universe Tab 10.1, that also had its US sales stopped a week ago. The Government Circuit would likely choose to stay, putting the products back on store shelves, but for now, we imagine Sammy is going to be searching longingly at Posner's court docket.
