This just has not been Samsung's summer time. On the top of Apple winning its earliest civil suit against Samsung, the Worldwide Trade Commission just passed out a preliminary determination that Apple did not violate any one of four Samsung patents (including two apparently standards-essential good examples) by providing the iPad and apple iphone. While Judge James Gildea did not openly outline why Apple was out of the woods, he added that Samsung lacks a domestic business that utilizes the patents -- important when it is attempting to claim economic harm in america. The verdict still gives Samsung four or five months' room to breathe as the ITC looks at the decision, but it is difficult to see Samsung taking pleasure in the lower offensive strength when it is already around the defensive in American courtrooms.
