Within the latest salvo within the legal fight between Apple and HTC, Apple has an argument towards the Worldwide Trade Commission that Andy Rubin, now of Google, really started focus on aspects of Android while at Apple, reviews Florian Mueller of FOSS Patents.

The statement from Apple that's incorporated within the complaint is very interesting:

Mr. Rubin started his career at Apple in early the nineteen nineties and labored like a low-level engineer particularly confirming towards the creators from the 263 [realtime API] patent in the exact time their invention had been created and developed. [...] It's thus no surprise the infringing Android platform used the stated subsystem approach from the 263 patent that enables for versatility of design and allows the woking platform to become highly easy to customize and expanding as HTC touts.

The argument is dependant on the violation of two patents, such as the 263 realtime API patent. Apple states that Rubin was confirming towards the designers of this patent at Apple in the very time that they are inventing it. This, they are saying, provided inspiration for that Android framework.

Apple provided this statement like a clarification it felt it needed to give because HTC had brought the commission to think that Rubin had begun the job on Android at General Miracle or Danger. Apple says here that Android really started at Apple. Although this might not have any direct effect on the HTC situation, it might have far-reaching effects on future cases that Apple undertakes against Google or other Android manufacturer such as the lately acquired Motorola.
